Terms and Conditions for Salish Mushrooms, LLC

1. Introduction

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the website (the “Website”, “Site”), the Forayz web application, the Morel Maps iOS application, and any related services (collectively, the “Service”) operated by Salish Mushrooms, LLC (“us”, “we”, “Company”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Privacy Policy

Please review our Privacy Policy to understand how we collect, use, and safeguard your information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

3. Eligibility and Account Registration

Age Requirement: You must be at least 13 years of age to create an account or use our digital services. By creating an account, you represent and warrant that you are at least 13 years old and agree to our Terms and Privacy Policy.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Authentication Methods: We offer multiple methods to create and access your account, including:

Sign in with Apple
Sign in with Google

By using third-party authentication services, you also agree to their respective terms of service and privacy policies.

4. Membership Tiers and Subscriptions

Our Service offers multiple access levels:

Public Access: Limited access to basic map features and public content without account registration.

Free Membership: Access to environmental data layers, basic mapping features, and select educational content. Requires account registration.

Pro Membership: Full access to all features, including advanced map overlays (historical burns, timber harvests, areas of interest), offline map downloads, commenting features, and premium educational content. Pro membership requires a paid subscription.

Subscription Terms:

Pro memberships may be purchased through our website, through Apple In-App Purchase (iOS app), or Google Play (Android app).
Subscriptions automatically renew unless canceled before the renewal date.
Refund policies for subscriptions are governed by the platform through which the subscription was purchased (website, Apple App Store, Google Play).

5. Refund and Cancellation Policy

Online Courses and Educational Content:

Refunds for online courses will be honored up to the scheduled start date.

Guided Tours and Events:

Guided tours may be canceled up to 48 hours prior to the scheduled time for a full refund.
Refund requests received after these deadlines are not eligible for a refund.

Pro Memberships:

Website subscriptions: Contact us for refund requests within 48 hours of initial purchase.
iOS App Store subscriptions: Refunds are handled through Apple according to their refund policies.
Google Play Store subscriptions:Refunds are handled through Google according to their refund policies

6. Forayz Mapping Application and Morel Maps iOS App

Our digital mapping services (Forayz web application and Morel Maps iOS app) provide interactive maps for mushroom foraging. By using these services, you acknowledge and agree:

Accuracy Disclaimer:

Map data, including public land boundaries, terrain features, and environmental layers, may be inaccurate, outdated, or incomplete.
Environmental data (soil moisture, temperature, precipitation, snow cover) is provided for informational purposes and should not be relied upon as the sole basis for foraging decisions.
Fire perimeter data, timber harvest data, and other historical information may not reflect current conditions.

Location Data:

Our mapping services may collect and process your location data to provide location-based features.
You may disable location services at any time through your device settings.

Offline Features:

Offline map downloads are available to Pro members only.
Downloaded maps are for personal use only and may not be redistributed.

Third-Party Services: Our mapping services utilize third-party providers including:

MapLibre (map tiles and geospatial services)
Cloudflare (content delivery and data hosting)
Apple MapKit (iOS integration)

Use of our mapping services is also subject to these providers’ terms of service.

7. Map Disclaimer and Limitations

The maps provided through our Service are for general informational purposes only and should not be relied upon as the sole source of navigation, land ownership, or safety information. Users acknowledge and agree to the following:

Public land designations on our maps may be inaccurate, outdated, or incomplete. Users are responsible for verifying the legal status of any land before entry.
Our maps do not indicate all potential hazards, including but not limited to dangerous terrain, wildlife areas, unstable ground, or changing weather conditions. Users assume all risks when traveling to locations shown on our maps.
Our maps should not be relied upon as a primary navigation tool for backcountry travel. Users should always carry proper navigation equipment and backup systems when venturing into remote areas.
Some areas shown on our maps may be inaccessible or restricted due to seasonal closures, private property restrictions, conservation efforts, or other limitations not reflected in our mapping service.
We make no warranties, expressed or implied, regarding the accuracy, completeness, reliability, or suitability of our maps for any purpose.
Users are solely responsible for obtaining necessary permits, permissions, or paying applicable fees for accessing any locations shown on our maps.

8. User-Generated Content

By submitting content to the Service, including but not limited to comments, photos, location markers, and areas of interest, you grant Salish Mushrooms, LLC a perpetual, non-exclusive, royalty-free, worldwide license to use, modify, publish, and distribute such content for promotional and operational purposes.

You represent and warrant that:

You own or have the necessary rights to submit such content.
Your content does not violate any third-party intellectual property rights or applicable laws.
Your content does not contain unlawful, defamatory, or harmful material.

We reserve the right to remove any user-generated content at our sole discretion.

9. Mushroom Foraging and Safety Disclaimer

Participants acknowledge the inherent risks of consuming wild mushrooms, including the possibility of misidentification, which may result in illness or death. In addition:

Any mushroom identification, descriptions, or classifications provided through our Service, whether in courses, maps, guides, the Bolete Finder tool, or other materials, are for educational and informational purposes only.
Users are solely responsible for accurately identifying any mushrooms they handle, collect, or consume. Salish Mushrooms, LLC does not assume liability for any consequences resulting from your choices or actions.
Even correctly identified edible wild mushroom species can cause adverse reactions in some individuals. All wild mushrooms should be thoroughly cooked before consumption, and users should start with small quantities when trying a new species.
Individual sensitivities, improper preparation, or consumption of spoiled specimens of even correctly identified edible species can result in illness or, in rare cases, death.
Users should never consume any wild mushroom unless they are 100% certain of its identification and edibility.
Our information regarding edibility, toxicity, or medicinal properties of mushrooms is based on generally accepted knowledge at the time of publication, but such knowledge may change over time.

10. Educational Materials and Learning Platform Disclaimer

Educational materials provided through our courses, learning management system, or events are for informational purposes only. Salish Mushrooms, LLC assumes no responsibility for how this information is applied in practice. Always consult a professional for any specific guidance related to mushroom foraging, identification, or consumption.

Course enrollment and access are subject to your membership tier. Some courses may be restricted to Pro members.

11. Limitation on Resale and Redistribution

You may not reproduce, resell, or distribute any materials, including but not limited to digital downloads, guides, course content, map data, or offline map downloads, provided through the Service without prior written consent from Salish Mushrooms, LLC.

12. Photography Consent

You grant Salish Mushrooms, LLC the right to use photographs or videos taken during events for promotional, educational, or informational purposes across social media, blogs, or other channels. If you wish to request the removal of specific photos, please contact info@salishmushrooms.com.

13. Accessibility Statement

We are committed to ensuring that our Website and Services are accessible to all users, including those with disabilities. If you encounter any accessibility issues, please contact us at info@salishmushrooms.com so we can address your concerns promptly.

14. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any portion of the Service
Interfere with or disrupt the Service or servers
Scrape, harvest, or collect information from the Service without authorization
Share your account credentials with others
Circumvent access controls or membership restrictions
Use automated systems or bots to access the Service

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

16. Force Majeure

Salish Mushrooms, LLC shall not be held liable for any delay or failure in performance resulting from events beyond our reasonable control. These events include but are not limited to natural disasters, government actions, labor strikes, internet service interruptions, or third-party service provider outages.

17. Dispute Resolution

Most concerns can be resolved quickly by contacting info@salishmushrooms.com. However, in the unlikely event that we cannot resolve your complaint to your satisfaction, we agree to resolve disputes through binding arbitration with the American Arbitration Association (AAA).

Arbitration will take place on an individual basis only. Group, collective, or class actions are not permitted.
This provision does not prevent either party from seeking relief in small claims court for eligible disputes.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

18. Limitation of Liability

To the maximum extent permitted by law, Salish Mushrooms, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our Website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
